Our Service uses automated tools including artificial intelligence to manage content creation, scheduling, publishing, performance analysis, audience engagement, email marketing, lead generation, and affiliate marketing.

3. Use of Third-Party Platforms Our Service integrates with third-party platforms including TikTok, YouTube, Instagram, Facebook, Pinterest, X (Twitter), GoHighLevel, Stripe, and affiliate networks. Your use of these platforms is subject to their respective terms of service and privacy policies. We access these platforms through their official APIs and comply with their developer terms and policies.

When you authorise our application to access your accounts on these platforms, we may publish, schedule, and manage content on your behalf; access public profile information and analytics data; view content performance metrics; manage customer relationships and email communications; and process affiliate links and track referral performance. You may revoke access to any connected platform at any time through that platform's settings.

4. AI-Generated Content Our Service uses artificial intelligence to generate and optimise content including text, images, video, and audio. You acknowledge that content published through the Service may be AI-generated or AI-assisted. You are responsible for reviewing and approving content before it is published on your accounts. We include appropriate disclosures on AI-generated content as required by applicable laws and platform policies.

5. User Responsibilities You agree to provide accurate information when using the Service, comply with all applicable laws and regulations, comply with the terms of service of all connected third-party platforms, not use the Service to publish content that is illegal, harmful, infringing, or violates third-party rights, not attempt to interfere with or disrupt the Service, not reverse engineer, decompile, or disassemble any part of the Service, and ensure that content published through your accounts complies with advertising disclosure requirements including FTC guidelines for affiliate marketing.

6. Intellectual Property Content created through the Service using AI tools is subject to applicable intellectual property laws regarding AI-generated works. Our platform, including its design, code, algorithms, and branding, is owned by Colosseum Intelligence and protected by applicable intellectual property laws.

7. Data Handling We collect and process data as described in our Privacy Policy. By using the Service, you consent to our data practices as outlined in that policy.

8. Payment and Fees Certain features of the Service may require payment. If applicable, fees will be communicated clearly before you incur any charges. Payment processing is handled by third-party providers such as Stripe. We do not store your payment card details.

9. Disclaimer of Warranties The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee specific results from use of the Service, including revenue, audience growth, or content performance.

Limitation of Liability To the maximum extent permitted by law, Colosseum Intelligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, goodwill, or platform account standing.

11. Termination We reserve the right to suspend or terminate access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.
